These Terms & Conditions (“Terms”) are a legal agreement between you (“you”, “your”, the “customer”, “renter”, “member”, or “participant”) and Bondi Surf Girls (“BSG”, “we”, “us”, or “our”).

These Terms apply to every service, facility, event, communication and product offered by BSG, including without limitation: surfboard and wetsuit rentals; surfboard storage; community surf meet-ups; social events; workshops and retreats; member benefits and partner offers; the bondisurfgirls.com website, mobile experience and member dashboard; online accounts; and any other activity or interaction with BSG, its owners, organisers, coaches, volunteers, contractors, agents and representatives (collectively, “BSG Personnel”).

By visiting our website, creating an account, booking or attending any event, paying any fee, renting any equipment, storing any item with us, attending any meet-up, subscribing to any communication, or otherwise engaging with BSG, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use our services.

Important risk warning (Civil Liability Act 2002 (NSW), s 5M)

Surfing, paddling, swimming, ocean activities, yoga, group fitness, travel, and community events are dangerous recreational activities that carry significant and unavoidable risks of serious personal injury, permanent disability and death, as well as loss of or damage to property.

Risks include, but are not limited to: drowning and near-drowning; hypothermia and heat-related illness; being struck by waves, sandbars, reefs, rocks, boards (your own or others'), fins, leashes, or other equipment; collisions with other water users; cuts, lacerations, sprains, fractures, concussions, spinal and neck injuries; dislocations and drowning secondary to such injuries; rips, currents, tides, shore-break, changing weather, wind, swell, lightning, storms, cold and heat; marine life including sharks, bluebottles, jellyfish, stingers, urchins and stonefish; pollution, water quality and waterborne illness; slips, trips and falls on wet, sandy or uneven surfaces; the acts or omissions of other participants, third parties and BSG Personnel; equipment failure or malfunction; the physical demands of yoga, stretching, exercise and travel; exhaustion, dehydration, pre-existing medical conditions, allergies and reactions; motor vehicle and transport incidents; alcohol consumption at social events; theft, loss and damage to personal property.

This is a risk warning under section 5M of the Civil Liability Act 2002 (NSW). By engaging with any BSG service, you acknowledge that you have been warned of these obvious and inherent risks, and you voluntarily accept them.

1. Definitions

  • BSG Personnel means BSG's owners, directors, employees, organisers, hosts, coaches, instructors, yoga teachers, photographers, volunteers, contractors, agents and representatives.
  • Services means any service, facility, product, event, meet-up, workshop, retreat, storage, rental, communication, website, app, account, membership, benefit, discount or other offering provided, arranged, promoted or facilitated by BSG.
  • Recreational Services has the meaning given in section 139A of the Competition and Consumer Act 2010 (Cth), and includes surfing, swimming, bodyboarding, paddling, ocean activities, yoga, fitness, and any other activity involving a significant degree of physical exertion or risk.
  • Equipment means any surfboard, wetsuit, bodyboard, fin, leash, wax, lock, chain, accessory or other item owned, supplied or made available by BSG.
  • Garage means the surfboard storage facility operated by BSG at the address notified in your welcome email.
  • Event means any community surf, meet-up, social, class, workshop, retreat, trip, competition, launch or gathering organised, promoted or attended by BSG.

2. Eligibility & Accounts

2.1 Minimum age

  • You must be at least 18 years old to rent Equipment, hold a Storage membership, attend Salty Socials or any event where alcohol is served, or book a workshop or retreat.
  • Participants aged 16–17 may attend free community surf meet-ups only with the prior written consent of a parent or legal guardian who expressly accepts these Terms on the minor's behalf and who remains fully responsible for the minor at all times.
  • Children under 16 are not permitted to participate in any BSG activity.

2.2 Fitness and ability

  • You represent and warrant that you are in good physical and mental health, are a competent swimmer able to swim at least 200 metres in open ocean unaided, and are fit to participate in the activities you choose to engage in.
  • You are solely responsible for assessing your own skill level, fitness, medical condition, and the suitability of conditions, Equipment and activities for you. If you are in any doubt, you must not participate.
  • You must disclose any medical condition, injury, disability, pregnancy, allergy or medication that could affect your participation or the safety of others. BSG may, at its absolute discretion, refuse or discontinue your participation.

2.3 Identification

BSG may require a government-issued photo ID, proof of address, a valid payment card in your name, or other verification before providing any Service. BSG may refuse service to any person at its sole discretion.

2.4 Online accounts

  • You are responsible for the accuracy of the information you provide and for keeping your password, access codes, and account secure. You must not share your account, access codes, keys, or lockbox codes with any person.
  • You are liable for all activity occurring under your account. Notify us immediately at hello@bondisurfgirls.com of any unauthorised use.
  • BSG may suspend or terminate any account at any time, with or without notice, for any reason, including suspected breach of these Terms.

3. Assumption of Risk, Release & Waiver

This section is important. Please read it carefully. It affects your legal rights.

3.1 Voluntary assumption of risk

You voluntarily and knowingly assume all risks associated with your engagement with BSG and the Services, whether known or unknown, foreseeable or unforeseeable, including without limitation the risks identified in the Important Risk Warning above, risks arising from the condition of the ocean, beach, Garage, venue, Equipment, transport, food, drinks, accommodation, and the acts, omissions, negligence or misconduct of BSG Personnel, other participants, or any third party.

3.2 Waiver of rights under the Australian Consumer Law for Recreational Services

To the maximum extent permitted by section 139A of the Competition and Consumer Act 2010 (Cth) and sections 5L, 5M and 5N of the Civil Liability Act 2002 (NSW), you agree that:

  • The consumer guarantees in sections 60 and 61 of the Australian Consumer Law (guarantees as to due care and skill, fitness for purpose, and reasonable result) do not apply to any Recreational Services supplied by BSG;
  • Any contract term requiring BSG or BSG Personnel to exercise reasonable care and skill in supplying any Recreational Service is excluded, restricted and modified to the maximum extent permitted by law;
  • You waive any right to sue BSG or BSG Personnel in respect of any death, personal injury, physical or mental harm (including the contraction, aggravation or acceleration of a disease), contraction of illness, the coming into existence, aggravation or acceleration of any condition, or any loss or damage to property, arising out of, in connection with, or incidental to the supply of any Recreational Service, whether caused by negligence or otherwise.

This waiver does not apply to significant personal injury caused by reckless conduct as defined in section 139A(5) of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified.

3.3 Release

To the maximum extent permitted by law, you release, discharge and forever hold harmless BSG and BSG Personnel from any and all claims, demands, actions, causes of action, suits, proceedings, rights, damages, losses, costs and expenses (including legal costs on a full indemnity basis), of every kind and nature, whether known or unknown, foreseen or unforeseen, arising out of or in any way connected with your use of, participation in, or interaction with any Service, Equipment, Event, Garage, venue or BSG Personnel, including (without limitation) any such claim based in negligence, breach of statutory duty, breach of contract, or otherwise.

3.4 Dangerous recreational activity (Civil Liability Act 2002 (NSW), s 5L)

You acknowledge that surfing, ocean activities, paddling, swimming at unpatrolled or patrolled beaches, and the other physical activities offered or facilitated by BSG are dangerous recreational activities. You accept that BSG is not liable in negligence for any harm you suffer as a result of the materialisation of an obvious risk of a dangerous recreational activity.

3.5 Binding on representatives

This release and waiver is binding on you and on your heirs, executors, administrators, personal representatives, assigns and next of kin.

4. Board & Equipment Rentals

4.1 Rental agreement

Each rental is a separate hire contract on these Terms. Equipment remains at all times the property of BSG (or its licensor). You receive only a limited, non-transferable right to use the Equipment during the agreed rental period.

4.2 Inspection and condition

  • You must inspect the Equipment at pickup and immediately report any defect, damage or concern. Taking the Equipment is conclusive evidence that it is in good and serviceable condition, suitable for your skill level, and fit for your intended use.
  • You must use the Equipment only for its intended purpose, within your ability, in safe conditions, and in accordance with all lifeguard instructions, posted signage, and applicable law.

4.3 Loss, damage and theft

You are fully and strictly liable for any loss, theft, damage, disappearance or deterioration of the Equipment (other than reasonable wear and tear) from the moment you take possession until the Equipment is inspected and accepted as returned by BSG, regardless of cause and regardless of fault.

  • Indicative repair/replacement charges (BSG may charge more if actual cost is higher):
    • Surfboard damage or loss: up to AUD $1,200 per board;
    • Wetsuit damage or loss: up to AUD $250;
    • Bodyboard damage or loss: up to AUD $200;
    • Fin, leash, lock, chain, wax or accessory: replacement cost plus 15% handling fee.
  • You authorise BSG to charge your nominated payment method for any loss, damage, late-return fee, cleaning fee, replacement cost, tow/recovery cost, or other amount payable under these Terms, at any time up to 60 days after the end of the rental period.
  • You must not attempt any repair yourself. All damage must be reported immediately.

4.4 Late return

  • A late-return fee of AUD $40 per item applies, plus AUD $40 per additional hour (or part thereof) beyond the agreed return time.
  • If Equipment is more than 24 hours overdue and no contact has been made, BSG may treat the Equipment as stolen, report the matter to police, and charge the full replacement cost to your payment method.

4.5 Prohibited use

You must not: (a) use the Equipment outside of Greater Sydney without BSG's prior written consent; (b) sub-hire, lend, sell, pledge or part with possession of the Equipment; (c) use the Equipment in dangerous, prohibited or unpatrolled conditions, outside flagged areas, under the influence of alcohol or drugs, or in breach of any law or lifeguard direction; (d) allow any person other than you to use the Equipment; or (e) use the Equipment for any commercial, competitive, filming or instructional purpose.

4.6 Refunds

No refund, credit or pro-rata adjustment is payable for early return, unused rental time, surf conditions, weather, illness, injury, change of mind, or any other reason, except as required by non-excludable law.

4.7 Your safety on rented Equipment

Surfing and ocean use of rented Equipment is a Recreational Service and a dangerous recreational activity. Section 3 (Assumption of Risk, Release & Waiver) applies in full to all Equipment rentals, including any injury to you, any third party, or any property.

5. Board Storage

5.1 Licence only — no bailment

BSG grants paid members a non-exclusive, revocable, personal licence to place one surfboard (or similar board-shaped item expressly permitted by BSG) on an assigned rack space in the Garage for the duration of the paid membership period. BSG is not a bailee, warehouseman, storage operator under the Warehousemen's Liens Act, insurer, or custodian of any board or property stored in the Garage. No possession or control over your board passes to BSG.

5.2 Storage at your own risk

Your board and any other property are stored in the Garage entirely at your own risk. To the maximum extent permitted by law, BSG and BSG Personnel are not liable for any loss, theft, damage, deterioration, mould, moisture, water ingress, fire, smoke, pest, vandalism, graffiti, act of God, accidental or deliberate damage, or any other harm affecting your board or property, however caused (including by the negligence of BSG or BSG Personnel, or the act, default or negligence of any other member or third party).

5.3 Security is your responsibility

  • You must supply and use your own heavy-duty lock, and ensure your board is locked at all times when stored.
  • You must not share, duplicate, photograph or disclose any access code, key or lockbox combination. You are fully responsible for any loss, damage or unauthorised entry arising from your disclosure or negligent storage of access credentials.
  • You must ensure the Garage is fully secured (door closed, locked, codes scrambled) every time you leave.
  • Any surveillance camera or deterrent is provided as a courtesy only. BSG does not represent or warrant that any camera is operational, monitored, or will prevent or record any incident.

5.4 Permitted items

  • You may store one (1) surfboard up to 9ft, plus a fin, leash and wax, in your assigned space. No other items may be stored without prior written consent from BSG.
  • You must not store hazardous, illegal, flammable, perishable, living, valuable, sentimental or irreplaceable items. BSG may, without liability, dispose of any non-permitted item at your cost.

5.5 Fees & cancellation

  • Storage fees are payable monthly in advance and renew automatically until you cancel.
  • To cancel, email hello@bondisurfgirls.com from the email linked to your membership. Cancellations take effect at the end of the current billing cycle. No refund or pro-rata credit is payable for the remaining period, partial months, unused days, or for any reason including change of mind, injury, travel, or inability to access the Garage.
  • If any fee is overdue by more than 7 days, BSG may suspend access and charge a AUD $25 reinstatement fee.

5.6 Removal, abandonment and disposal

  • If your membership ends, is suspended, or fees remain overdue by more than 30 days, BSG may remove your board from the Garage and store it elsewhere at your cost and risk.
  • If your board is not collected within 42 days of a written notice sent to your email on file, BSG may treat the board as abandoned and may, without further notice and without liability, sell, donate, recycle or dispose of the board and apply any proceeds toward outstanding fees, removal and disposal costs.
  • You release BSG from any claim arising from such removal, storage or disposal.

5.7 Insurance

You acknowledge that BSG does not insure your board or any other property in the Garage. You are strongly encouraged to arrange your own contents or personal property insurance. BSG makes no representation about whether any policy will cover your property.

6. Community Surf Meet-ups

Community surfs (including the Wednesday Sunrise Surf and any other meet-up) are informal, unguided, unsupervised social gatherings, not lessons, tours, courses, guided sessions, or organised events.

  • BSG does not provide instruction, coaching, supervision, lifeguarding, safety assessment, risk assessment, rescue, first aid, or professional advice of any kind. Any tip, comment or suggestion offered by another participant or by BSG Personnel is personal opinion only and is not professional advice.
  • BSG Personnel attending any meet-up do so as fellow participants, not as instructors, guides, lifeguards or safety officers, and owe you no duty of care in relation to your safety, conditions, skill level or Equipment.
  • BSG does not assess surf, weather, swell, wind, tide, current, rip, marine life, water quality or any other conditions. You are solely responsible for deciding whether to enter the water, when to exit, what Equipment to use, and how to manage your safety.
  • Meet-ups proceed regardless of conditions. BSG may change, relocate, cancel, shorten or not attend any meet-up at any time without notice, refund, compensation or liability.
  • You must follow all lifeguard, council and emergency services directions. Always surf within your ability, inside flagged areas where required, and never alone.
  • Section 3 (Assumption of Risk, Release & Waiver) applies in full.

7. Social Events (Salty Socials and similar)

  • Social events are casual, voluntary gatherings at third-party venues. The venue (not BSG) is responsible for the premises, food, drinks, safety, licensing and service of alcohol.
  • You are solely responsible for your own alcohol consumption, conduct, transport and safety. Drink responsibly and within the law. BSG does not supply or serve alcohol and is not responsible for any act, omission, intoxication, incident, injury, illness or property damage at or arising from any social event.
  • BSG reserves the right to refuse or remove any attendee whose conduct is unsafe, unlawful, intoxicated, harassing or contrary to our Code of Conduct (section 12).
  • Photos and video may be captured. See section 13 (Media, Photography & Content).
  • Section 3 (Assumption of Risk, Release & Waiver) applies in full.

8. Workshops & Paid Events (including Surf Wellness Day)

Workshops (including yoga, surf and photography workshops) and other paid BSG events are Recreational Services. Sections 3 and 19 apply in full.

8.1 Bookings and payment

  • Your place is confirmed only once full payment has been received and BSG has issued a written confirmation. Places are limited and allocated first-come, first-served.
  • All prices are in Australian Dollars (AUD) and include GST where applicable.

8.2 Cancellation and refunds

  • Workshop and paid-event tickets are non-refundable. No refund, credit or pro-rata adjustment is payable if you cancel, change your mind, cannot attend, are ill or injured, or fail to show up.
  • We are, however, happy for you to transfer your ticket to another person. Email hello@bondisurfgirls.com at least 24 hours before the event with the new attendee's full name, email and phone number so we can update the booking and send them the pre-event information. Transfers inside 24 hours are at BSG's discretion.
  • Tickets may not be on-sold, scalped or resold for more than face value. The replacement attendee is bound by these Terms on the same basis as the original ticket-holder.
  • If BSG cancels or reschedules due to weather, safety, insufficient numbers, illness of instructors, force majeure or any other reason, we will, at our discretion, reschedule, provide a credit, or refund the fee paid. This is your sole and exclusive remedy for such cancellation or rescheduling.
  • BSG is not liable for any consequential loss including travel, accommodation, time off work or non-refundable bookings.

8.3 Health and fitness

  • Yoga, surf and physical components of workshops carry risk of injury. You must disclose any relevant medical condition, injury, pregnancy, or limitation before the workshop.
  • Hands-on yoga adjustments, physical contact or demonstration may occur. You may decline at any time. Your continued participation without objection is deemed consent.
  • You are responsible for following instruction at your own pace, resting when needed, and withdrawing from any activity at your own discretion.

Surf Wellness Day — Specific Terms

The following clauses (8.4–8.10) apply in addition to clauses 8.1–8.3 and the remainder of these Terms, and prevail to the extent of any inconsistency in respect of Surf Wellness Day (and any similarly structured BSG wellness, yoga-plus-surf, sunrise-surf-plus-photo, or partner-inclusive event).

8.4 What's included

Surf Wellness Day is a paid BSG event that may include: (i) a group yoga class hosted at a third-party yoga studio (currently BodyMindLife, Bondi); (ii) a guided group surf session at Bondi Beach; (iii) in-water action photography by a BSG-engaged photographer; (iv) after-surf coffee at a nearby café; and (v) Liquid I.V. or other partner hydration products. Inclusions, partners, venues, instructors, photographers, schedules, products, durations and start times may change, be substituted, shortened, relocated, split across venues or withdrawn at any time without notice and without refund, credit or compensation.

8.5 Bookings, transfers and substitutions

  • Places are strictly limited (currently 20 per event) and allocated first-come, first-served. A booking is confirmed only once full payment has cleared via our checkout/ticketing partner and BSG has issued written confirmation to the email you provided.
  • Tickets are non-refundable but transferable to another person under clause 8.2. Email hello@bondisurfgirls.com at least 24 hours before the event with the new attendee's full name, email and phone number. Transfers inside 24 hours are at BSG's discretion.
  • Tickets must not be on-sold, scalped or resold for more than face value. The replacement attendee is bound by these Terms, must meet the fitness, swimming and medical-disclosure requirements in clauses 8.3 and 8.9, and must consent to the photography release in clause 8.9.
  • Transfer to a future Surf Wellness Day date (rather than to another person) is not offered as of right; BSG may, at its sole discretion, move you to a future event where it is reasonable to do so.

8.6 Strict no-refund policy (including for bad surf conditions)

No refunds — please read

Surf Wellness Day tickets are non-refundable.By booking, you acknowledge that you are paying for access to a curated experience, not a guaranteed surfing outcome, and that surf, weather, tide and ocean conditions are entirely outside BSG's control.

No refund, credit, discount, part-refund or pro-rata adjustment is payable in any of the following circumstances (or any similar circumstance):

  • Flat, windy, choppy, blown-out, dumpy, close-out, onshore, dangerous, crowded, small or otherwise “bad” surf conditions;
  • Rain, cold, heat, storms, lightning, low visibility, poor water quality, bluebottle presence, shark sightings, or any other weather, ocean or beach condition;
  • Beach or venue closure by lifeguards, council, police or emergency services;
  • Your change of mind, cold feet, nerves, menstruation, fatigue, hangover, sunburn, allergy, illness, injury, pregnancy, or any other personal or medical circumstance arising before or on the day;
  • Your late arrival, failure to attend, failure to find the meeting point, or departure before the event ends;
  • Your decision not to enter the water, not to attend the yoga class, not to collect or use photos, not to collect coffee, or not to use any other inclusion;
  • Travel disruption, public transport failure, traffic, parking difficulty, road closure, strike, work commitment, childcare issue, or any other logistical issue affecting your attendance;
  • Any substitution, change or withdrawal of inclusions, partners, venues, instructors, photographers, products or schedule permitted under clause 8.4;
  • Dissatisfaction with conditions, inclusions, instruction, wave count, photo quality or quantity, coffee, hydration product, or any aspect of the event.

If BSG cancels the event entirely and is unable to offer a reasonable rescheduled date (including where cancellation is due to force majeure, government order, venue loss, instructor illness or critical safety concern), your sole and exclusive remedyis, at BSG's election, a transfer to the next available Surf Wellness Day or a credit of equal value toward a future BSG workshop, rental or event, valid for 12 months from the date of issue. Cash refunds are not automatic and will be granted only at BSG's absolute discretion and only to the extent required by non-excludable law.

8.7 The event proceeds in virtually all conditions

You acknowledge and accept that surf quality, swell, wind, tide, weather and crowd levels are unpredictable and outside BSG's control. The yoga component proceeds rain, shine, flat or solid. The water component proceeds in nearly all conditions. Where lifeguards close the beach, or BSG's lead instructor in their sole judgement considers the water unsafe or unsuitable, BSG may (without liability and without refund or credit beyond clause 8.6) replace or modify the water component with an alternative activity of equivalent duration, including beach-based fitness, board skills on sand, breath-work, extended yoga, a beach walk, or a photography walk.

8.8 Third-party venues, partners and products

Surf Wellness Day is intentionally built around independent third-party partners. You acknowledge that BSG does not own, operate, staff, control or insure those third parties. To the maximum extent permitted by law:

  • Yoga studio (BodyMindLife or equivalent). Your attendance at the studio is subject to the studio's own rules, waivers and terms of entry. BSG is not liable for any injury, illness, loss, theft or damage arising in, at or in connection with the studio (including reception, change rooms, stairs, amenities, practice room, lockers or car park).
  • Coffee café. After-surf coffee is provided at an independent café. BSG is not responsible for food or beverage ingredients, allergens, food safety, dietary requirements, preparation, service, wait times, premises safety or anything occurring on the café's premises. You must disclose severe allergies directly to the café and rely on your own enquiries. A coffee alternative (tea, water, non-dairy milk) is not guaranteed.
  • Liquid I.V. / hydration supplier. Hydration products are manufactured and supplied by an independent third party. They contain sodium, sugar, electrolytes and (in some variants) caffeine and other ingredients. You consume any such product entirely at your own risk. If you are pregnant, breastfeeding, a minor, have kidney, heart, blood-pressure, diabetic or thyroid conditions, are caffeine-sensitive, have any allergy or intolerance, or are on any medication, do not consume unless you have first obtained clearance from your doctor. BSG makes no representation as to safety, suitability, ingredients or effect. You must read the label.
  • In-water photographer. The photographer is an independent contractor. BSG makes no guarantee as to number of photos, lighting, focus, framing, exposure, editing, delivery format, delivery date, cloud-link expiry or archiving. Photos are typically delivered within 7–14 days to the email on your booking. Lost, expired or corrupted download links are not re-issued as a matter of right. BSG is not liable for any distress or disappointment arising from photo output.

Any complaint in respect of a third-party venue, partner or product must be directed to that third party. Your contract for third-party goods and services is with the third party, not with BSG.

8.9 In-water session, safety, fitness and photography release

  • You represent and warrant that you can swim at least 200 metres unaided in open ocean, are medically and physically fit to surf and practice yoga, and have disclosed any condition, injury, pregnancy, allergy or medication that could affect your participation. BSG may, at its sole discretion and without refund, exclude you from any component on safety grounds.
  • The water component is an informal group surf for enjoyment and photography — it is not a certified surf lesson, coaching session, guided tour, safety briefing or rescue service. BSG Personnel and the photographer are present to support and capture the experience, not to lifeguard, rescue, risk-assess, select waves, judge positioning, or intervene in your decisions.
  • You must follow all lifeguard, instructor, studio-staff and photographer directions, including exiting the water, moving out of a hazard, or stopping an exercise. Failure to follow a direction is at your own risk and may result in removal from the event without refund.
  • You must not surf, practice yoga or consume any hydration product while under the influence of alcohol, drugs or medication that affects judgement or reaction time.
  • Photography release. By attending you consent to being photographed and filmed in and out of the water, and you grant BSG the perpetual, irrevocable, worldwide, royalty-free, sub-licensable licence described in section 13 to use, adapt, publish and commercialise your name, image, likeness and voice for any BSG community, editorial, marketing, advertising or commercial purpose, without further notice, approval or payment.
  • Photos delivered to you are for your personal, non-commercial use only. You must not sell, license, sub-license or use them in any commercial, brand, sponsorship, talent or advertising context without BSG's prior written consent. Where you publish a delivered photo on social media, you must credit @bondisurfgirls where reasonably practicable.

8.10 Assumption of risk, release and indemnity (Surf Wellness Day)

Without limiting sections 3, 17, 18 and 19, by booking, paying for, attending or participating in any part of Surf Wellness Day, you specifically acknowledge and agree that:

  • You voluntarily and knowingly assume all risks of surfing, paddling, open-ocean swimming, yoga, stretching, group physical activity, travel between venues, food and beverage consumption, and use of supplied products and equipment, whether the risk is obvious or not, known or unknown, and whether arising from BSG's negligence or otherwise;
  • You release, discharge and forever hold harmless BSG, BSG Personnel, the photographer, the yoga teacher, the yoga studio, the café, the hydration supplier, and every other third-party partner involved in Surf Wellness Day from all claims, demands, actions, liabilities, costs and expenses of every kind — including for personal injury (up to and including death), illness, psychological harm, loss of or damage to property (including your surfboard, wetsuit, phone, car, bag, jewellery, keys and clothing), and any consequential, indirect or economic loss — arising out of or in any way connected with the event, whether caused by negligence or otherwise, to the maximum extent permitted by law;
  • You indemnify and keep indemnified BSG against any claim made against BSG by any other participant, water user, studio guest, café patron, partner or member of the public arising from your act, omission, breach of these Terms, or breach of the Code of Conduct at section 12;
  • You acknowledge that BSG does not carry personal accident, medical, ambulance or property insurance for Surf Wellness Day participants, and you are strongly encouraged to arrange your own private health, personal accident and contents insurance before attending;
  • This release, waiver and indemnity is binding on you and on your heirs, executors, administrators, personal representatives, assigns and next of kin, and survives the event.

9. Retreats & Trips (Third-Party Providers)

Surf retreats, trips and travel experiences listed, promoted or featured by BSG are provided by independent third parties (including but not limited to partner resorts, tour operators, airlines, transfer providers, instructors, accommodation providers, and insurers). BSG is not the provider, seller, agent or organiser of those services unless expressly stated in writing.

  • Your contract for any retreat or trip is with the relevant third-party provider and is subject to that provider's own terms, conditions, cancellation policies, and waivers.
  • BSG gives no representation, warranty or guarantee (express or implied) about any third-party provider, service, facility, itinerary, accommodation, transport, food, safety, instruction, experience level, or suitability.
  • To the maximum extent permitted by law, BSG is not liable for any act, omission, default, negligence, cancellation, delay, insolvency, injury, illness, loss, damage or dissatisfaction of or caused by any third-party provider.
  • You are responsible for arranging and maintaining your own comprehensive travel insurance (including medical, evacuation, cancellation, baggage and personal liability), valid passports and visas, vaccinations and health requirements, and for complying with local laws.

10. BSG Club Membership, Perks & Partner Offers

10.1 BSG Club subscription

  • BSG Club (“the Club”) is an optional paid membership that unlocks third-party partner discounts (“Perks”) and member-only benefits. Membership is billed monthly in advance at the price displayed at signup (currently AUD $29.00/month, or AUD $19.00/month for founding members during the founding-price period), via our payment partner. An annual prepay option may also be offered at checkout; annual prepayments are non-refundable.
  • Minimum commitment — 3 months. By joining the Club you commit to a minimum of 3 consecutive paid months of membership. This minimum exists because the Club unlocks one-off partner Perks of substantial value (for example, discounts of 25% on a wetsuit or $150 on a surfboard) that would not be offered on a month-to-month basis. The 3-month minimum is disclosed to you before signup on the /membership page and you accept it by completing the order form.
  • No cancellation within the minimum period. You may not cancel your Club subscription before you have paid for 3 consecutive months. If you request cancellation within the minimum period, at BSG's election either (a) the subscription will continue to bill monthly until 3 paid months have elapsed and then terminate, or (b) you may settle the balance of the remaining minimum months in a single lump-sum payment, on receipt of which the subscription will end immediately. No refund, credit or pro-rata adjustment is payable for months paid during the minimum period, in any circumstance, including change of mind, redemption of one-off partner Perks, illness, injury, travel, relocation, or dissatisfaction with any Perk.
  • Cancelling after the minimum. From month 4 onwards you may cancel at any time by emailing hello@bondisurfgirls.com from the email linked to your membership. Cancellation takes effect at the end of the current paid month. No refund or pro-rata credit is payable for the unused portion of the current paid month.
  • Annual prepay subscriptions. If you elect an annual prepay option at checkout, the full annual amount is charged upfront and is strictly non-refundable, including for change of mind, illness, injury, travel, relocation, redemption of one-off partner Perks, or dissatisfaction with any Perk. The annual term will not auto-renew without your consent at the next renewal date; you may choose not to renew, but no pro-rata refund is payable for the unused portion of the current annual term.
  • Failed payment during the minimum. If a monthly payment fails and cannot be recovered within 10 days, BSG may suspend your Perks access until payment is made, but your 3-month minimum obligation remains, and amounts owing for any months during the minimum period remain payable.
  • Discount codes expire on cancellation. Your Club discount codes remain active until the end of the final paid month and are deactivated thereafter. Recurring partner discounts (for example, discounted yoga or pilates memberships at a partner studio) revert to the partner's standard price from the next billing cycle at that partner.
  • Founding-member pricing. Founding-member pricing is applied via a coupon at original signup only, is capped at the first 50 memberships, and is non-transferable. If you cancel and rejoin later, founding pricing will not be available on the new subscription, regardless of whether a founding slot is technically unfilled. The founding coupon applies a monthly discount for 3 months, after which the standard monthly price applies automatically.
  • Price changes. BSG may change the standard monthly price for the Club on 30 days' notice to your email on file. You may cancel (subject to the minimum) before any increase takes effect.
  • Waiver. BSG may, in its sole discretion and in exceptional circumstances (for example, serious illness or relocation), waive part or all of the 3-month minimum. Any waiver is granted case-by-case and does not create a right or expectation of future waiver.

10.2 Perks & partner offers

  • Perks, discounts, promo codes and partner offers are provided by third-party partners and are subject to that partner's terms, availability, eligibility, blackout dates, expiry, and change without notice.
  • Perks are personal to you, non-transferable, not redeemable for cash, and may be withdrawn or altered at any time without notice.
  • BSG does not guarantee that any Perk will be honoured by any partner. Any dispute relating to a Perk must be resolved directly with the partner. BSG accepts no liability for any loss, damage or disappointment arising from any Perk.
  • Abuse of any Perk (including sharing codes, commercial use, or misrepresentation) may result in suspension or termination of your account and clawback of any benefit received. For the avoidance of doubt, suspension or termination for abuse does not release you from the 3-month minimum obligation, nor entitle you to any refund of an annual prepayment.

11. Payments, Cancellations & Refunds

11.1 Prices and payment

  • All prices are in AUD and (where applicable) include GST. Prices may change at any time before a booking is confirmed.
  • Payment is taken in advance through our payment processor (currently Stripe) or at pickup as indicated. By submitting payment details you authorise BSG to charge your payment method for the relevant amount, plus any additional amounts payable under these Terms (including damage, loss, late return, cleaning, no-show, or overdue fees) up to 60 days after the relevant Service.
  • You warrant that you are the authorised holder of the payment method and that funds are available. Failed, reversed, charged-back or disputed payments may result in suspension and recovery of costs.

11.2 Refund policy

  • Rentals: no refund for early return, unused time, weather, change of mind, surf conditions, injury, illness, or inability to use.
  • Storage: no refund for the current or previous billing periods on cancellation, suspension or inability to access.
  • BSG Club membership: no refund or pro-rata adjustment for any months paid during the 3-month minimum commitment, or for the unused portion of the current paid month after cancellation. Annual prepay subscriptions are strictly non-refundable, including for the unused portion of the current annual term. See section 10.1.
  • Community Surfs & Salty Socials: free — no refund payable.
  • Workshops: see section 8.2.
  • Surf Wellness Day: strictly non-refundable in all circumstances, including for bad surf conditions. See sections 8.4–8.10.
  • Retreats/Trips: per the third-party provider's cancellation policy. BSG does not refund any amount not recovered from the provider.
  • Any refund that is payable will be made to the original payment method within 14 business days.

11.3 Chargebacks

Before raising a chargeback, please contact us first. Unjustified chargebacks may result in recovery action and suspension of services. You agree to indemnify BSG for any reasonable costs, fees and charges associated with responding to an unjustified chargeback.

12. Code of Conduct

BSG is built around safety, inclusion, respect and trust. You agree at all times (including in person, online, in community channels, and with BSG Personnel) to:

  • Treat every person with respect, kindness and dignity, regardless of gender identity, sexuality, ability, race, religion, age, body or background;
  • Never engage in harassment, discrimination, bullying, intimidation, sexual misconduct, violence, doxxing, stalking, or unlawful behaviour;
  • Respect personal space, consent and boundaries, including in the water, at events and online;
  • Follow lifeguard, BSG Personnel and venue directions; comply with all beach, council, state and federal laws;
  • Not attend any activity while impaired by alcohol, drugs or prescription medication that affects judgement or safety;
  • Not film, photograph or record other participants without consent;
  • Look after the ocean and the beach — leave no trace, no single-use plastic, no cigarette butts.

BSG may, without liability or refund, remove, suspend or permanently ban any person who breaches this Code, and may report conduct to police or other authorities. You indemnify BSG for any loss, damage or liability arising from your breach of this Code.

13. Media, Photography & Content

  • BSG and its photographers, videographers and social media partners may capture photographs, video, audio, live streams and other content (“Content”) at any Event, meet-up, workshop, trip or Service.
  • By attending or participating, you grant BSG a perpetual, irrevocable, worldwide, royalty-free, sub-licensable licence to use, reproduce, adapt, edit, publish, broadcast, distribute and display the Content (including your name, image, voice and likeness) in any media now known or later developed, for BSG's community, editorial, marketing and commercial purposes, without further notice, approval or compensation.
  • If you do not wish to appear in Content, you must notify BSG in writing before the relevant Event and take reasonable steps during the Event (e.g. by standing out of frame). BSG will use reasonable efforts to respect such requests but accepts no liability for incidental capture or publication.
  • You must not publish, tag, re-post or distribute any Content of another participant without that participant's consent.
  • Any user-generated content you submit to BSG (stories, reviews, photos, posts) is licensed to BSG on the same terms above. You warrant that you own or have all necessary rights to that content and that it does not infringe any right or law.

14. Privacy & Personal Information

BSG collects, uses and discloses personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using our Services you consent to our collection and use of your personal information to provide Services, process payments, communicate with you, send newsletters and marketing (from which you may unsubscribe at any time), protect the safety and security of the Services, and comply with law.

We may disclose your information to service providers (including payment processors such as Stripe, email and CRM providers such as HighLevel, hosting providers, analytics providers) and to authorities where required by law. 15. Third-Party Services

Our website and Services may link to, integrate with or rely on third-party services (including Stripe, HighLevel, Supabase, Google, Meta, venues, transport operators, retreat partners and insurers). BSG is not responsible for, and makes no warranty in respect of, any third-party service, content, outage, error, security incident, data breach, or term. Your use of any third-party service is governed by that third party's own terms.

16. Intellectual Property

All intellectual property in the Bondi Surf Girls name, logo, brand, website, content, photographs, videos, designs, illustrations (including the BSG Creations hand-drawn artwork), and member materials is owned by BSG or its licensors. You may not copy, modify, reproduce, distribute, sell, commercialise, scrape, train AI on, or use any BSG intellectual property without our prior written consent. We may revoke any limited use right at any time.

17. Force Majeure & Changes to Services

BSG is not liable for any failure or delay in providing any Service caused by events beyond its reasonable control, including weather, storms, swell, dangerous surf, beach or Garage closure, lightning, fire, flood, disease, pandemic, public health order, government action, industrial action, utility failure, third-party failure, equipment failure, theft, or force majeure. BSG may at any time change, suspend, reschedule or discontinue any Service, price, Event, meet-up, workshop or facility, with or without notice, without liability.

18. Indemnity

To the maximum extent permitted by law, you indemnify and keep indemnified BSG and BSG Personnel against all claims, demands, proceedings, losses, damages, liabilities, fines, penalties, costs and expenses (including legal costs on a full indemnity basis) arising out of or in connection with:

  • Your use of, or participation in, any Service, Equipment, Event, Garage or facility;
  • Any act, omission, negligence, wilful misconduct or breach of these Terms by you or anyone acting on your behalf;
  • Any injury, illness, death, loss or damage caused or contributed to by you, to yourself, any BSG Personnel, any other participant, any third party, or any property;
  • Any claim by a third party (including other beach users, venue patrons, landlords, or members of the public) arising from your conduct;
  • Any loss, theft or damage to Equipment or property in storage;
  • Any breach by you of any law or third-party right, including intellectual property or privacy rights.

19. Limitation of Liability & Consumer Law

19.1 Non-excludable rights

Nothing in these Terms excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified (including any non-excludable right under the Australian Consumer Law). Where liability can be limited, it is limited as set out in this section.

19.2 Limitation

Where BSG is liable for a breach of a consumer guarantee that cannot be excluded, BSG's liability is, at BSG's option, limited to:

  • In the case of goods — replacement or repair of the goods, supply of equivalent goods, or payment of the cost of replacement, repair or equivalent; and
  • In the case of services — resupply of the services, or payment of the cost of having the services resupplied.

19.3 Monetary cap

To the maximum extent permitted by law, BSG's total aggregate liability to you arising out of or in connection with any Service, Event, Equipment, storage, account or these Terms — whether in contract, tort (including negligence), statute or otherwise — is limited to the total fees you have paid to BSG for the specific Service giving rise to the liability in the 3 months immediately preceding the event giving rise to the claim, or AUD $100, whichever is greater.

19.4 Exclusion of consequential loss

To the maximum extent permitted by law, BSG is not liable for any indirect, consequential, special, incidental, punitive or exemplary loss or damage, loss of profit, loss of revenue, loss of opportunity, loss of data, loss of goodwill, loss of enjoyment, disappointment, travel or accommodation costs, or loss that is not the direct and natural result of our breach.

19.5 No insurance

You acknowledge that BSG may not carry public liability, personal injury, contents or property insurance in respect of participants, Equipment, stored property or Events. You are strongly encouraged to obtain your own personal accident, private health, contents and travel insurance appropriate to your participation.

20. Dispute Resolution

Before commencing any court or tribunal proceeding, you agree to first notify BSG of any dispute in writing at hello@bondisurfgirls.com with full details, and to engage in good-faith discussions (including, if requested by BSG, a without-prejudice meeting or mediation) for at least 30 days. This clause does not prevent BSG from seeking urgent injunctive or equitable relief.

21. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.

22. Changes to these Terms

BSG may update these Terms at any time by posting an updated version on bondisurfgirls.com/terms. The “Effective date” above will be updated. Your continued use of any Service after the updated Terms take effect constitutes acceptance. If you do not agree to any change, you must stop using the Services and cancel any ongoing subscription.

23. General

  • Entire agreement. These Terms, together with any written booking confirmation, waiver or signed document, constitute the entire agreement between you and BSG and supersede all prior representations, understandings and agreements.
  • No reliance. You have not relied on any representation, statement, promise or assurance from BSG that is not expressly set out in these Terms.
  • Severability. If any provision is held to be invalid, illegal or unenforceable, it is to be read down to the extent necessary to make it valid, or severed, without affecting the remainder of these Terms.
  • No waiver. Failure or delay by BSG in exercising any right does not operate as a waiver of that right.
  • Assignment. You may not assign your rights under these Terms. BSG may assign or novate its rights and obligations freely.
  • Survival. Sections 3, 4.3, 5.2, 5.6, 8.6, 8.8, 8.9, 8.10, 10.1, 13, 16, 18, 19 and 21 survive termination or expiry of these Terms.
  • Electronic acceptance. You agree that tick-box acceptance, payment, attendance or use of any Service constitutes your electronic signature and binding acceptance of these Terms.
